ΟΡΙΣΜΟΣ ΗΜΕΡΟΜΗΝΙΑΣ ΤΕΛΕΥΤΑΙΑΣ ΕΝΗΜΕΡΩΣΗΣ ΤΗΣ ΚΤΗΜΑΤΟΛΟΓΙΚΗΣ ΒΑΣΗΣ ΤΟΥ ΔΗΜΟΥ ΘΕΣΣΑΛΟΝΙΚΗΣ ΚΑΙ ΕΝΗΜΕΡΩΣΗ ΓΙΑ ΤΙΣ ΔΙΑΔΙΚΑΣΙΕΣ ΩΣ ΤΙΣ ΠΡΩΤΕΣ ΕΓΓΡΑΦΕΣ

Με απόφαση της Ε.Κ.Χ.Α. Α.Ε. ορίστηκε ως τελευταία ημέρα ενημέρωσης της τηρούμενης κτηματολογικής βάσης του Δήμου Θεσσαλονικης η Τετάρτη 1 Ιουλίου 2015. Από την ημερομηνία αυτή εκκινούν οι διαδικασίες περαίωσης της κτηματογράφησης και καταχώρισης των πρώτων εγγραφών στα Κτηματολογικά Βιβλία. Ο προσδιορισμός της συγκεκριμένης ημερομηνίας αφορά τους πολίτες για τους εξής λόγους:

 1. Εξακολουθεί να ισχύει η, με ποινή ακυρότητας, υποχρέωση για μνεία και επισύναψη πιστοποιητικού κτηματογραφούμενου ακινήτου (το προμηθεύεστε από το αρμόδιο γραφείο Κτηματογράφησης) σε όλα τα συμβολαιογραφικά έγγραφα με τα οποία μεταβιβάζεται, αλλοιώνεται, τροποποιείται ή καταργείται εμπράγματο ή άλλο εγγραπτέο δικαίωμα που αφορά ακίνητα του Δήμου Θεσσαλονίκης. Επιπλέον εξακολουθεί να ισχύει η υποχρέωση προσκόμισης του πιστοποιητικού για τη συζήτηση ενώπιον Δικαστηρίου για υπόθεση με αντικείμενο εγγραπτέο δικαίωμα. Από 1/7/2015 αίρεται η υποχρέωση υποβολής δήλωσης εγγραπτέου δικαιώματος (δήλωση Δ2) και η υποβολή των νέων πράξεων θα γίνεται αποκλειστικά στο υποθηκοφυλακείου, με ευθύνη του οποίου θα μεταβιβάζονται στο Κτηματολογικό Γραφείο. 

2. Οι πράξεις που θα μεταγραφούν ή εγγραφούν στα βιβλία του Υποθηκοφυλακείου κατά την περίοδο από1/7/2015 μέχρι την έναρξη λειτουργίας του Κτηματολογίου θα διαβιβαστούν σε αυτό με ευθύνη του Υποθηκοφύλακα. Από την ΕΚΧΑ ΑΕ, για διευκόλυνση της διαδικασίας, συνιστάται η επισύναψη απλό αντίγραφο του πιστοποιητικού κτηματογραφούμενου ακινήτου στις προς καταχώριση πράξεις (ακόμα και για αυτές που δεν απαιτείται από το νόμο [αγωγές, ανακοπές, διακστικές αποφάσεις]), ώστε να καταστεί ευκολότερος ο εντοπισμός των ακινήτων που αφορούν.

3. Αν με την πράξη που καταχωρήθηκε στο Υποθηκοφυλακείο κατά την παραπάνω περίοδο επέρχονται γεωμετρικές μεταβολές στο ακίνητο (λ.χ. λόγω κατάτμησης, συνένωσης, σύστασης πραγματικής δουλείας διόδου, αποτύπωσης χώρων αποκλειστικής χρήσης λόγω σύστασης κάθετης ιδιοκτησίας κ.α.), τότε οι δικαιούχοι οφείλουν, μετά την έναρξη λειτουργίας του Κτηματολογίου, να λάβουν κτηματολογικό διάγραμμα, ώστε ο ιδιώτης μηχανικός να προβεί σε σύνταξη διαγράμματος γεωμετρικών μεταβολών, προκειμένου να ενημερωθεί η βάση. Η προσκόμιση αντιγράφου του τοπογραφικού διαγράμματος και του διαγράμματος χωρικών μεταβολών αποτελεί προϋπόθεση για την ολοκλήρωση της καταχώρισης της πράξης. 

Κατόπιν των ανωτέρω καθίσταται φανερό ότι βρισκόμαστε στην τελευταία φάση πριν την έναρξη λειτουργίας του Κτηματολογίου για τον Δήμο Θεσσαλονίκης. Συμβουλεύουμε τους ιδιοκτήτες των ακινήτων που ανήκουν στο Δήμο Θεσσαλονίκης να μην παραμελήσετε τον έλεγχο των στοιχείων των πρώτων εγγραφών (αυτών δηλαδή που θα εμφανίζονται στο Κτηματολόγιο κατά την έναρξή του) προκειμένου να διαπιστώσετε αν εμφανίζονται σε αυτές σωστά τα δικαιώματά τους. Σε περίπτωση εντοπισμού σφάλματος πρέπει, εντός αποκλειστικής προθεσμίας πέντε ετών, να επικοινωνήσετε με τον δικηγόρο σας, ο οποίος ως μόνος αρμόδιος, θα προβεί σε όλες τις απαραίτητες διαδικασίες για τη διόρθωση των σφαλμάτων. Η μη διόρθωσή τους μπορεί να επιφέρει βλαπτικές συνέπειες, καθώς μετά την παρέλευση της πενταετίας οριστικοποιούνται οι πρώτες εγγραφές, γεγονός που μπορεί να οδηγήσει σε απώλεια δικαιωμάτων επί ακινήτων και πιθανόν περιέλευσή τους στο Ελληνικό Δημόσιο, ειδικά στην περίπτωση που αυτά εμφανίζονται ως “αγνώστου ιδιοκτήτη“.
