ΤΡΟΠΟΠΟΙΗΣΗ ΔΙΑΤΑΞΕΩΝ ΠΟΥ ΑΦΟΡΟΥΝ ΣΤΑ ΣΥΝΑΙΝΕΤΙΚΑ ΔΙΑΖΥΓΙΑ

Δημοσιεύθηκε στις 22-12-2017 στην Εφημερίδα της Κυβέρνησης (ΦΕΚ Α΄201/2017) ο νόμος 4509/2017 με τον οποίο τροποποιούνται διάφορες διατάξεις βασικών Κωδίκων (Αστικού, Πολιτικής Δικονομίας, Ποινικής Δικονομίας κλπ), ανάμεσα στις οποίες και οι σχετικές με τη λύση του γάμου με συναινετικό διαζύγιο. Ειδικότερα:

 

Στο άρθρο 22 του νόμου ορίζεται πως οι σύζυγοι μπορούν να λύσουν το γάμο τους τόσο με αμετάκλητη δικαστική απόφαση (κατ’ αντιδικία), όσο και με συμφωνία. Η τελευταία συνάπτεται μεταξύ των συζύγων με την απαραίτητη παρουσία και συνδρομή δικηγόρου, όπως δηλαδή συνέβαινε μέχρι σήμερα, ή μόνο από τους εφοδιασμένους με ειδικό πληρεξούσιο δικηγόρους. Με τον ίδιο τρόπο καταρτίζεται και συμφωνία για τη ρύθμιση των ζητημάτων επικοινωνίας, διατροφής και επιμέλειας των τέκνων, εφόσον υπάρχουν. Η διάρκεια της συμφωνίας αυτής είναι τουλάχιστον διετής. 

Μετά την κατά τα παραπάνω κατάρτισή τους, οι σχετικές συμφωνίες κατατίθενται σε συμβολαιογράφο και όχι, πλέον, ενώπιον Δικαστηρίου. Το απαραίτητο συμβολαιογραφικό έγγραφο καταρτίζεται τουλάχιστον δέκα (10) ημέρες μετά την υπογραφή της συμφωνίας. Ημέρα έναρξης της δεκαήμερης θεωρείται εκείνη της θεώρησης του γνήσιου των υπογραφών των μερών από τη Γραμματεία του Ειρηνοδικείου στην Περιφέρεια του οποίου εδρεύει ο συμβολαιογράφος που θα εγκρίνει τις συμφωνίες. 

Ο συμβολαιογράφος συντάσσει συμβολαιογραφική πράξη επικύρωσης των συμφωνιών, την οποία υπογράφουν τόσο οι σύζυγοι και οι πληρεξούσιοι δικηγόροι τους ή μόνο οι τελευταίοι, εφόσον είναι εφοδιασμένοι με ειδικό πληρεξούσιο. Οι διατάξεις περί επικοινωνίας και διατροφής του τέκνου εκτελούνται με τίτλο το συμβολαιογραφικό έγγραφο μόνο εάν σε αυτό συμπεριλαμβάνονται οι ρυθμίσεις των άρθρων 950 και 951 του Κώδικα Πολιτικής Δικονομίας που καθορίζουν, αντίστοιχα, τα κατάλληλα μέσα εκτέλεσης. Η υπό όρους, πάντως, εκτελεστότητα του συμβολαιογραφικού εγγράφου πυροδοτεί επιφυλάξεις στο βαθμό που σύμφωνα με την ΚΠολΔ 904 τα συμβολαιογραφικά έγγραφα είναι, χωρίς πρόσθετους όρους, εκτελεστοί τίτλοι. 

Η λύση του γάμου ολοκληρώνεται με την καταχώριση της συμβολαιογραφικής πράξης έγκρισης της συμφωνίας λύσης στο αρμόδιο ληξιαρχείο. Πάντως, διατηρείται η υποχρέωση πνευματικής λύσης του γάμου, για την οποία συνεχίζουν να ισχύουν όσα ίσχυαν μέχρι τη δημοσίευση του νόμου.

Μετά την πάροδο της συμφωνηθείσας διάρκειας τα μέρη αποφασίζουν και συμφωνούν εκ νέου για τα ζητήματα της επιμέλειας, επικοινωνίας και διατροφής του τέκνου με νέα έγγραφη συμφωνία, για την οποία ακολουθείται η ίδια διαδικασία. 

Η νεοπαγής διάταξη πυροδοτεί ερωτήματα, νομικά και δικαιοπολιτικά, και επιφυλάξεις. Πρωτίστως, όμως, γιγαντώνει τη γραφειοκρατία με την επιβολή τήρησης μη αναγκαίων τύπων (βλ. βεβαίωση γνήσιου υπογραφής από τον Γραμμετέα του Ειρηνοδικείου).
