ΨΗΦΙΣΤΗΚΕ ΤΟ ΠΟΛΥΝΟΜΟΣΧΕΔΙΟ ΜΕ ΤΙΣ ΤΡΟΠΟΠΟΙΗΣΕΙΣ ΣΕ ΠΤΩΧΕΥΤΙΚΟ ΚΩΔΙΚΑ ΚΑΙ ΠΑΡΑΒΟΛΑ

Ψηφίστηκε σήμερα στη Βουλή νόμος που εισάγει τροποποιήσεις στον Πτωχευτικό Κώδικα, στη Διοικητική Δικαιοσύνη, σε δικαστικά τέλη και παράβολα, ενώ παράλληλα ρυθμίζονται θέματα όπως η οικειοθελής αποκάλυψη φορολογητέας ύλης, οι ηλεκτρονικές συναλλαγές κ.α. Το συνολικό κείμενο του νομοσχεδίου θα το βρείτε συνημμένο στο παρόν (βλ. τέλος ανάρτησης). Εκκρεμεί η δημοσίευση στην Εφημερίδα της Κυβέρνησης.

Με τον νόμο, ανάμεσα σε άλλα, καταργείται η υποχρέωση καταβολής δικαστικού ενσήμου στις αναγνωριστικές αγωγές, τόσο αυτές που είχαν ασκηθεί πριν την δημοσίευσή του όσο και τις μεταγενέστερα ενώ επίσης δεν καταβάλλεται δικαστικό ένσημο για όσες ασκήθηκαν ως καταψηφιστικές και τράπηκαν σε αναγνωριστικές μετά τη δημοσίευση [άρθρο 33].

Περαιτέρω μειώνεται το καταβαλλόμενο δικαστικό ένσημο στις περιπτώσεις των εργατικών διαφορών, για τις οποίες καταβάλλεται, στο μισό (4‰) [άρθρο 34].

Εισάγεται για πρώτη φορά υποχρεωτική καταβολή παραβόλου υπέρ του ΤΑΧΔΙΚ σε περίπτωση αίτησης αναβολής της συζήτησης της υπόθεσης ενώπιον του δικαστηρίου [άρθρο 35]. Ο αιτών διάδικος θα πρέπει να καταβάλει για αναβολή:

  • ενώπιον Ειρηνοδικείου και Μονομελούς Πρωτοδικείου παράβολο ποσού είκοσι (20) ευρώ,
  • ενώπιον του Πολυμελούς Πρωτοδικείου παράβολο ποσού τριάντα (30) ευρώ, 
  • ενώπιον του Εφετείου παράβολο ποσού σαράντα (40) ευρώ.

Αναπροσαρμόζονται επίσης τα παράβολα για την κατάθεση ενδίκων μέσων και διαμορφώνονται ως εξής:

Α. Για το ένδικο μέσο της έφεσης:

  • κατά απόφασης Ειρηνοδικείου παράβολο ποσού εβδομήντα πέντε (75) ευρώ,
  • κατά απόφασης Μονομελούς Πρωτοδικείου παράβολο ποσού εκατό (100) ευρώ,
  • κατά απόφασης Πολυμελούς Πρωτοδικείου παράβολο ποσού εκατόν πενήντα (150) ευρώ.

 

Β. Για το ένδικο μέσο της αναίρεσης:

  • κατά απόφασης Ειρηνοδικείου παράβολο ποσού διακοσίων πενήντα (250) ευρώ,
  • κατά απόφασης Μονομελούς Πρωτοδικείου παράβολο ποσού τριακοσίων (300) ευρώ,
  • κατά απόφασης Πολυμελούς Πρωτοδικείου παράβολο ποσού τετρακοσίων (400) ευρώ,
  • κατά απόφασης Εφετείου παράβολο ποσού τετρακοσίων πενήντα (450) ευρώ.

 

Γ. Για το ένδικο μέσο της αναψηλάφησης:

  • κατά αποφάσεων ειρηνοδικείων, μονομελών και πολυμελών πρωτοδικείων παράβολο ποσού τετρακοσίων (400) ευρώ,
  • κατά αποφάσεων Εφετείου και του Αρείου Πάγου παράβολο ποσού πεντακοσίων (500) ευρώ.

 

Δ. Για το ένδικο μέσο της ανακοπής ερημοδικίας 

  • σε ποσό που δεν μπορεί να είναι μικρότερο από εκατόν είκοσι (120) ευρώ και μεγαλύτερο από διακόσια (200) ευρώ, αν αυτή εκδίδεται από το Ειρηνοδικείο,
  • σε ποσό που δεν μπορεί να είναι μικρότερο από εκατόν πενήντα (150) ευρώ και μεγαλύτερο από διακόσια πενήντα (250) ευρώ, αν αυτή εκδίδεται από το Μονομελές Πρωτοδικείο, ή
  • σε ποσό που δεν μπορεί να είναι μικρότερο από διακόσια (200) ευρώ και μεγαλύτερο από τριακόσια (300) ευρώ, όταν εκδίδεται από το Πολυμελές Πρωτοδικείο ή το Εφετείο.

 

Όλα τα παραπάνω αφορούν τα πολιτικά δικαστήρια, ενώ αντίστοιχες ρυθμίσεις εισάγονται τόσο για τη διοικητική δικαιοσύνη όσο και για τις ποινικές διαδικασίες.
