ΑΝΑΡΤΗΣΗ ΚΤΗΜΑΤΟΛΟΓΙΚΩΝ ΣΤΟΙΧΕΙΩΝ ΑΧΑΙΑ ΑΤΤΙΚΗ

ΕΝΑΡΞΗ ΛΕΙΤΟΥΡΓΙΑΣ ΚΤΗΜΑΤΟΛΟΓΙΟΥ ΣΕ ΕΔΕΣΣΑ, ΚΑΤΕΡΙΝΗ, ΚΟΖΑΝΗ ΚΑΙ ΦΛΩΡΙΝΑ

Σύμφωνα με απόφαση της Ε.Κ.Χ.Α. Α.Ε. από τις 14 Οκτωβρίου 2015 τέθηκε σε λειτουργία το Κτηματολόγιο σε τέσσερις πρωτεύουσες νομών. Πρόκειται για τις πόλεις Έδεσσα, Κατερίνη, Κοζάνη και Φλώρινα. Με την εξέλιξη αυτή σηματοδοτείται η μετάβαση από το παλαιό σύστημα των Βιβλίων Μεταγραφών και υποθηκών στο νέο σύστημα του Κτηματολογίου, το οποίο παρέχει σημαντικά πλεονεκτήματα. Σημαντικό είναι να γνωρίζουν οι πολίτες ότι:

 

Με την έναρξη του Κτηματολογίου κάθε ακίνητο λαμβάνει ξέχωριστό κτηματολογικό φύλλο και ειδικό αριθμό ΚΑΕΚ (κωδικός αριθμός εθνικού κτηματολογίου). Σε αυτό αποτυπώνονται οι πρώτες εγγραφές, όπως προέκυψαν από την επεξεργασία των δηλώσεων στο στάδιο της Κτηματογράφησης. Το κόστος για την απόκτηση του φύλλου ανέρχεται σε 4,5 ευρώ. 

Σε περίπτωση που δεν εμφανίζονται δικαιώματα στα κτηματολογικά βιβλία ή σε περίπτωση που παρατηρούνται σφάλματα στην αποτύπωση των ακινήτων (όρια, εμβαδόν, θέση, όροφος) ή των δικαιωμάτων (πλήρης αντί ψιλής κυριότητας, επικαρπία αντί οίκησης κ.ο.κ.) παρέχεται προθεσμία πέντε ετών στους δικαιούχους των δικαιωμάτων προκειμένου να καταχωρίσουν τα δικαιώματά τους ή να διορθώσουν τα σφάλματα. Τούτο επιτυγχάνεται με τις διαδικασίες, εξώδικες και (ιδίως) δικαστικές που προβλέπει ο ν. 2664/1998. Η προθεσμία διόρθωσης για τους κατοίκους εξωτερικού, όπως και για το Ελληνικό Δημόσιο, είναι επτά έτη. 

Μετά την πάροδο της προθεσμίας (πέντε ή επτά ετών) οι πρώτες εγγραφές οριστικοποιούνται και παράγουν ως προς το περιεχόμενό τους αμάχητο τεκμήριο. Αυτό σημαίνει ότι δεν είναι δυνατόν να τροποποιθούν. Συνέπεια της οριστικοποίησης είναι η απώλεια κυριότητας προς ιδιώτη, σε περίπτωση που εμφανίζεται στα φύλλα ως δικαιούχος πρόσωπο διαφορετικό από τον πραγματικό κύριο, και η περιέλευση όλων των ακινήτων με την ένδειξη “άγνωστος ιδιοκτήτης” στο Ελληνικό Δημόσιο. 

Στις περιπτώσεις αυτές ο αληθής δικαιούχος χάνει το δικαίωμά του και κατ’ επέκταση το ακίνητό του, το οποίο ανήκει πλέον σε όποιον εμφανίζεται ως κύριος στο φύλλο. Ο παλιός ιδιοκτήτης μπορεί να εγείρει μόνο χρηματικές αξιώσεις για την απώλεια της κυριότητάς του. 

Από τα παραπάνω καθίσταται προφανής η ανάγκη ελέγχου των πρώτων εγγραφών και η διόρθωση των σφαλμάτων που μπορεί να εμφανίζονται, προκειμένου να αποφύγετε τις δυσμενείς συνέπειες από την οριστικοποίηση των εγγραφών.
